PART II — TERMS OF SERVICE

This section outlines the rules of behavior on OtterMart and the limitations of our liability.

1. Acceptance of Terms

By checking the "I Agree" box during registration and logging into OtterMart, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy Policy.

2. User Conduct and Zero-Tolerance Policy

OtterMart is a community platform meant for the benefit of the student body. You are solely responsible for your conduct and any content you post. You strictly agree NOT to use OtterMart for:

• Bullying and Harassment: Engaging in any form of cyberbullying, harassment, intimidation, or hate speech against any student, faculty, or individual.
• Illegal Activities: Promoting, facilitating, or engaging in any activity that violates the laws of the Republic of the Philippines (including, but not limited to, the Cybercrime Prevention Act of 2012).
• Defamation: Posting false, malicious, or defamatory content about others.
• NSFW Content: Uploading sexually explicit, violent, or otherwise inappropriate material.

Violation of these rules will result in immediate account suspension or permanent termination, and potential reporting to appropriate university or legal authorities.

3. Limitation of Liability and Indemnification

OtterMart is provided as a platform for student interaction. Otter Software Systems, its developers, and administrators shall NOT be held liable for any user-generated content, interactions, or actions taken by users on or off the platform.

• No Liability for Misconduct: Otter Software Systems assumes no responsibility or liability for any bullying, harassment, emotional distress, physical harm, or illegal activities committed by users utilizing the platform.
• Service Interruptions & Data Loss: The development team is not liable for server downtimes, scheduled or unscheduled service interruptions, or data loss resulting from unforeseen technical breaches, system failures, or force majeure events.
• User Responsibility: You acknowledge that you use OtterMart at your own risk. Any disputes between users are solely between the involved parties.
• Indemnification: You agree to indemnify and hold harmless Otter Software Systems from any claims, damages, lawsuits, or liabilities arising from your use of OtterMart, your violation of these terms, or your violation of any law or the rights of a third party.

4. Independence from PLM

OtterMart is an independent project developed by Otter Software Systems. It is NOT an official platform, project, or property of the Pamantasan ng Lungsod ng Maynila (PLM). The university is not responsible for the maintenance, content, or data handling of this application.

5. Changes to the Terms

We reserve the right to modify these terms at any time. We will notify users of any significant changes via email or an in-app notification. Continued use of OtterMart after such changes constitutes your consent to the updated terms.
